17. Partial nullity
If any clause of these terms is declared null and void or unenforceable by a court or competent body, the remaining clauses shall remain in full force and effect. The null clause shall be replaced by one that most closely approximates the economic purpose pursued by the parties.
18. Alternative dispute resolution
Xtampa will handle complaints sent to [email protected] and, where appropriate, provide information about competent alternative dispute resolution bodies. The former EU ODR platform is no longer operational following the repeal of Regulation (EU) 524/2013 by Regulation (EU) 2024/3228.
Professional customers (B2B): the parties may submit their disputes to mediation or arbitration by mutual agreement before resorting to legal proceedings.
19. Applicable law and jurisdiction
These terms are governed by Spanish law. For professional customers (B2B), disputes are submitted to the courts and tribunals of Murcia, with express waiver of any other jurisdiction that may apply. If the customer acts as a consumer (B2C), the court at their domicile shall have jurisdiction in accordance with mandatory consumer protection rules (art. 52 Code of Civil Procedure).
